TERMS OF SERVICE
These Terms of Service ("Terms") are a legal agreement between you and Greymark LLC ("Rip Chaser", "we", "us"). They govern your use of the ripchaser.com website and any related services (the "Service"). By accessing or using the Service, or by subscribing to a paid plan, you agree to these Terms. If you do not agree, do not use the Service.
1. What Rip Chaser Is
Rip Chaser is an informational reference tool for trading card products. We publish product checklists, parallel and insert breakdowns, pull odds, rookie flags, and indicative market prices. We are an independent service. We are not a card manufacturer, a grader, a marketplace, a broker, a dealer, or a financial or investment advisor. We do not buy, sell, appraise, authenticate, or guarantee any card, and nothing on the Service is an offer to buy or sell anything.
2. License to Use the Service
Subject to these Terms and any applicable subscription requirements, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial reference purposes. This license does not include any right to scrape, redistribute, or make commercial use of any content on the Service. We may revoke this license at any time if you violate these Terms.
3. About Our Data
Rip Chaser brings together card checklists, parallel and insert breakdowns, pull odds, rookie flags, and market prices from card manufacturers and public marketplaces. We work to keep this information accurate and current. Because it comes from third parties and changes constantly, we provide it for reference only and cannot guarantee its accuracy. A few things are worth knowing:
- Odds and checklists. These come from manufacturers' own published materials. Manufacturers note that actual contents and odds can vary, and product details are sometimes revised after release.
- Prices. Prices come from live eBay listings. They reflect current listings rather than confirmed sale prices, they move throughout the day, and not every card has an active listing at any given moment, so a price may be unavailable. Prices are refreshed periodically; the time of last refresh is displayed alongside each price. Due to current API capacity limitations, refresh intervals may vary and some prices may not reflect the most recent listings. We will disclose the age of displayed price data wherever possible.
- Rookie flags. Rookie flags and similar labels are based on external reference data.
We recommend confirming anything important to you, such as an odd, a print run, or a price, with the manufacturer or marketplace before relying on it. Rip Chaser is a research tool to support your own decisions, not a replacement for them.
4. Accounts
Some features require an account, created through an outside authentication provider (for example, Google, Apple, or Facebook). You must provide accurate information, keep your login secure, and are responsible for all activity under your account. You must be at least 13 years old to use the Service. We do not knowingly collect personal information from children under 13. If we discover that a user is under 13, we will promptly delete their account and any associated data. If you are under 18, you should subscribe only with a parent or guardian's permission. See our Privacy Policy for how we handle your data.
5. Subscriptions, Billing, and Cancellation
- Plans. Some data is free; premium features require a paid Pro subscription, offered monthly ($6.99/month) or annually ($59.99/year).
- Special and promotional pricing. We may from time to time offer promotional pricing or coupon codes, such as a limited founding rate for our first subscribers. Unless the offer expressly states otherwise, a promotional rate applies only for the promotional period stated in the offer; when that period ends, your subscription automatically renews at the then-current standard price for your plan. Promotional offers may be limited in quantity or duration, may not be combined with other offers, and may be modified or withdrawn at any time before you redeem them. If you cancel, you give up any promotional pricing, and if you resubscribe later you will be charged the standard price then in effect.
- Payment and renewal. Payments are processed by Stripe; we never see or store your card number. Accepted payment methods are those displayed at checkout and may vary by region and change over time. Subscriptions automatically renew at the applicable price for successive terms (monthly or annual) until you cancel. By subscribing you authorize recurring charges.
- Failed payments. If a payment fails, we may retry the charge one or more times. Access to paid features may be suspended until payment is successfully collected. We will attempt to notify you of a failed payment at the email address on your account.
- Cancellation. You may cancel at any time. Cancellation stops future renewals and takes effect at the end of your current paid period; you keep access until then.
- Refunds. Except where required by law, payments are nonrefundable, including for partial periods and periods of unused access. We may, at our discretion, offer a refund or credit. If you are located in the EU or UK, you may have statutory cancellation rights under applicable local law.
- Price changes. We may change prices or plan features. For recurring subscriptions we will give reasonable advance notice of a price increase by email to the address on your account, and it will take effect on your next renewal. Continuing your subscription after a price change takes effect means you accept the new price. Taxes may apply.
6. Acceptable Use
The data and content on Rip Chaser are provided for your own personal, non-commercial reference. You agree that you will not:
- scrape, crawl, harvest, bulk download, or use any automated means to access or extract data from the Service;
- copy, resell, republish, redistribute, or make our data available to any other party, or use it to build or train a competing product, dataset, or model;
- circumvent, disable, or interfere with the paywall, rate limits, security, or any access controls;
- share, resell, or transfer your account or subscription access; or
- use the Service unlawfully or in any way that disrupts or overburdens it.
We may throttle, suspend, or terminate access for any suspected violation.
7. Intellectual Property
The Service, including our compilation of data, original text, layout, branding, and software, is owned by Greymark LLC and protected by law. Card names, product names, logos, images, and other manufacturer or league marks belong to their respective owners and are used for identification and reference only; their appearance does not imply any affiliation with or endorsement by those owners. Card images shown on the Service originate from outside marketplace listings and are attributed to those listings. We claim no ownership of content that belongs to others.
8. Marketplace Links and Affiliate Disclosure
The Service links to outside marketplaces (for example, eBay). As an eBay Partner Network affiliate, we may earn a commission on qualifying purchases made through those links, at no extra cost to you. Those marketplaces are independent; we do not control them and are not responsible for their listings, prices, sellers, or transactions. Any purchase you make is solely between you and the seller or marketplace.
9. Service Availability
We work to keep the Service online and up to date, but we provide it on an "as available" basis and do not guarantee that it will be uninterrupted, free of errors, or available at any particular time. The Service may be unavailable due to maintenance, updates, outages at our providers, or other issues, and data may be delayed or temporarily missing. We are not liable for any downtime, and outages do not entitle you to a refund except where required by law. We may modify, suspend, or discontinue any part of the Service at any time.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the Service and all data and content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that any odds, checklist, price, value, or other information is accurate, complete, current, or reliable.
11. Limitation of Liability
To the maximum extent permitted by law, Greymark LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or the cost of any card or product (including any loss arising from your reliance on odds, checklists, prices, or values), arising out of or relating to your use of, or inability to use, the Service. Nothing in this section limits liability for fraud, gross negligence, or willful misconduct, or any liability that cannot be excluded by applicable law. Subject to the foregoing, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50. Depending on the laws where you live, some of these limits may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Greymark LLC from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, intellectual property, acceptable use, and indemnification provisions, will survive.
14. Changes to These Terms
We may update these Terms as the product evolves. We will revise the "last updated" date above, and for material changes we will notify subscribers by email to the address on file or by prominent notice on the Service at least 14 days before the changes take effect. Your continued use after changes take effect means you accept the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Missouri, without regard to conflict of laws rules. Before filing any formal dispute, you agree to first contact us and try in good faith to resolve it informally. Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in Missouri, and you consent to personal jurisdiction in those courts.
